Germany’s Federal Constitutional Court on data retention

Germany’s Federal Constitutional Court will hold a hearing on 15 December regarding complaints related to data retention. This makes it likely a verdict will be handed down in the first half of 2010. One potential outcome is that the Constitutional Court will once again present the case to the European Court of Justice, asking them to assess the law’s compliance with the basic rights of EU citizens.

In the meantime, the judges in Karlsruhe have extended their six-month block on the use of data already gathered by another six months. Among other items, there is one group complaint pending with the Constitutional Court, filed by more than 34,000 citizens who claim that retaining data on their Internet and telephone communications infringes their right to informational self-determination, that is the right to determine what happens to data about them.
